O R D E R

The petitioner, who was arrested and remanded to judicial custody on 25.08.2025, for the offences punishable under Sections 4(1)(C) r/w 4(1-A)(ii) of Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No. 459 of 2025 on the file of the respondent Police, seeks bail. 1/6

2. The case of the prosecution is that on 25.08.2025, at about 8.10am, when the respondent police were on regular patrol duty, they found that the petitioner was in illegal possession of 10 bottles of black pearl brandy (180ml each). Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence however, she is suffering incarceration from 25.08.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that there are 29 previous cases pending against the petitioner. Hence, he strongly opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side, taking into account that 29 previous cases were pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
