The learned counsel for the petitioners submits that the 4th respondentVijayakumar died and his mother, namely Senthamarai is already on record.

Since one of the L.R. of the deceased R4 is already on record, there is no abatement of the matter.

Though R3 name is appeared in the cause list, there is no representation on behalf of her.

Heard the learned counsel for the petitioner and the respondents 1 and 2.

Being satisfied with the reasons assigned in the affidavit filed along with the petition, the delay of 24 days in preferring the second appeal is condoned.

Registry is directed to number the second appeal if it is otherwise in order and list the same for admissionn.
