O R D E R

The petitioner, who was arrested and remanded to judicial custody on 15.07.2025, for the offences punishable under Sections 191(2), 191(3), 103(1) of BNS, Act, 2023 in Crime No.369 of 2025 on the file of respondent police, seeks bail.

2. The allegation against this petitioner is that due to previous enmity between the 1st accused and the deceased, while the deceased and his friends were consuming alcohol in a secluded place, this petitioner accompanied with 12 other accused persons, attacked the deceased with knife and caused him instant death. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case based on the confession of the co-accused. He submits that there is no specific overtact against the petitioner. Hence, he prays to grant bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.side) for the respondent police, submitted that the petitioner, who was accompanied with 12 other accused persons, had directly attacked the deceased as he was present at odd hours and had actively participated in the occurrence. He also submits that this Court, had already dismissed the bail application filed by second accused in this case and the investigation in this case is yet to be concluded. Hence, he strongly opposed to grant bail to the petitioner. 2/6

Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), that investigation in this case is yet to be concluded and one more accused is yet to be arrested, at this stage, this Court is not inclined to grant bail to the petitioner.
