2. The applicant asserts that Mr.Sharvan Lal Prajapati, who was carrying on business as Shivaganga Industries, passed away and that the impugned trade mark was transmitted to his wife, Mrs.Champa Devi, who is the registered proprietor thereof as on date.

3. On instructions, learned counsel for the private respondents submits that he has no objections to this application being allowed.
