Respondents Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st Respondent to forthwith take up and dispose of the pending Arbitration O.P No Na.Ka.L3/(Arbit)/10143/2019 dated 24.04.2019 on merit and in accordance with law within a time frame to be fixed by this Court and to further restrain the respondents form arbitrarily passing any unilateral orders with a view to close the matter and to pass.

For Petitioner : M/s.S.Sushmitha For Respondents 1, 2, 4, 5 & 6 : Mr.M.R.Gokul Krishnan Additional Government Pleader Order Heard M/s.S.Sushmitha learned counsel appearing for the petitioner and Mr.M.R.Gokul Krishnan, learned Additional Government Pleader, who takes notice on behalf of the respondents 1, 2 & 4 to 6. Since the Writ Petition is taken up for disposal at the stage of admission and 2/6

considering the nature of relief to be granted herein, notice to the third respondent is dispensed with.

The petitioner has filed this Writ Petition seeking for the following prayer:- i) For issuance of a mandamus directing the 1st respondent to forthwith take up and dispose of the pending Arbitration O.P. dated 24.04.2019 on merit and in accordance with law within a time frame to be fixed by this Court.

Learned counsel for the petitioner would submit that the petitioner's land was acquired by the respondents for four-land configuration of NH 45 C under the provisions of NH Act, and an award was passed on 05.01.2018; that as against the award of compensation, the petitioner filed an Arbitration Original Petition before the first respondent on 24.04.2019, as the petitioner was entitled to interest on the unpaid amounts from 04.03.2016 i.e from the date of acquisition and till the date of realization, however, even after lapse of six years, he said Petition is not yet disposed of. Hence, the present Writ Petition.

4. The learned Additional Government Pleader for the respondents 1, 2, 4 to 6 fairly submitted that the Arbitration Original Petition would be disposed of in accordance with law within the time, as stipulated by this Court.

In view of the submission made by the learned Additional Government Pleader for respondents 1, 2, 4 to 6 and considering the limited scope of the prayer, sought for by the petitioner, in this Writ Petition, this Court, without expressing any view with regard to the merits of the contentions putforth by the petitioner in the Writ Petition, is of the view that, suffice it would be to direct the first respondent to consider and dispose of the petitioners' Arbitration Original Petition in a time bound manner.

6. Accordingly, the Writ Petition is disposed of with a direction to the first respondent to consider the Arbitration Original Petition filed by the petitioner dated 24.04.2019 and dispose of the same as early as possible, 4/6

preferably, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
