Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to consider the representation of the petitioner-Company dated 21.07.2025 and to convert the land use from primary residential land to Industrial Land use based on the application of the petitioner-Company dated 25.03.2010. 2. This Writ Petition is filed seeking for a issuance of a mandamus to consider the representation of the petitioner-Company dated 21.07.2025 and to convert the land use from primary residential land to Industrial Land use based on the application of the petitioner-Company dated 25.03.2010.

The grievance of the petitioner-Company is for non-consideration of the representation made by them dated 21.07.2025 seeking for reclassification of the subject land from primary residential use to industrial use, inasmuch as, the petitioner's Industry falls under the category of ''Special and Hazardous (Red Category) under the provisions of the Town and Country Planing Act, 1971, necessitating the reclassification of the land for industrial use; that despite the fact that the previous management of the petitioner-Company filed an application dated 25.03.2010 for reclassification of the land for industrial use, the same was kept pending for more than 15 years, hence, the petitioner made a fresh representation dated 21.07.2025 requesting for consideration of the said application, however, as on date, neither the earlier application dated 25.03.2010 nor the representation made in the recent past has been considered, which 3/6

necessitated the petitioner to approach this Court by way of filing the present Writ Petition seeking for the aforesaid relief.

4. The learned counsel appearing for the petitioner submits that since the respondents are guilty of inaction in consideration of the petitioner's representation, a direction be issued to them to consider the same within a stipulated period.

5. The learned Special Government Pleader (T) for the respondents would submit that respondents 2 and 5 are the Competent Authorities to consider and dispose of the petitioner's representation dated 21.07.2025 and hence, sought for a suitable direction in that regard. 6.

Regard being had to the aforesaid facts and submissions made, and therefore, this Court without going to the merits of the contentions putforth by the petitioner either in the Writ Petition or in the Representation, disposes of this Writ Petition at the stage of admission with a direction to the respondents 2 and 5 to consider and pass orders on such representation 4/6

of the petitioner dated 21.07.2025 within a period of four months from the date of receipt of a copy of this order, in accordance with law and intimate the decision taken thereon to the petitioner.
