Challenging the dismissal order of the trial court, which was filed by the petitioners for cross examination of P.Ws.3, 6 and 24, the present petition has been filed.

2. The petitioners, after facing charges under Section 302 IPC, have filed a petition to cross examine the witnesses, viz., P.Ws.3, 6 and 24. The witnesses have already been cross examined effectively. However, the learned counsel for the petitioners on record, once again, filed a petition before the trial court to cross examine the witness, P.W.3, viz., Minor (eye witness) and other witnesses particularly, when the matter is posted 'for arguments'. When the witnesses have already been cross examined effectively, merely for the sake of the parties seeking cross examination, once again, the petitioners cannot be permitted to cross examine the witnesses.

3. That apart, it is not that petitioners have not given opportunity, the petitioners have already been cross examined the said witnesses in detail, 2/4

therefore, when the case has reached the stage of argument, this Court is of the view that the petition filed by the petitioners seeking to cross examine the witnesses is only to drag on the proceedings and the trial court has rightly rejected the same.

4. Accordingly, the present petition lacks merit and the order passed by the trial court does not require any interference. In the result, the present petition stands dismissed. Consequently, connected miscellaneous petition is closed.
