ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.06.2025, for the offences punishable under Sections 296(b), 191(2),191(3), 109,103 of BNS r/w Section 3(a) of IES Act 1908 and 25(1A),27(2) of Arms Act, 1959 in Crime No.147 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that due to previous enmity the petitioner joined hands with other accused and went to the defacto complainant's house and assaulted the complainant's son with knife and also thrown country made bomb. Due to which the defacto complainant's son sustained injuries and succumbed to the injuries. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that there was a case in counter in Cr.No.145 of 2023 which was registered two days prior to the occurrence. He further submitted that when the petitioner was standing and chatting along with friends the incident has happened and the petitioner is no way connected with the offence. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has no previous case. He further submitted that this Court has dismissed the earlier bail application filed by the petitioner in Crl.O.P.No.3538 of 2025 dated 02.09.2025 5.

Considering the facts, gravity of offence and the fact that this Court has dismissed the earlier bail application filed by the petitioner in Crl.O.P.No.3538 of 2025 dated 02.09.2025 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner. 6.
