(Order of the Court was made by C.V.Karthikeyan, J.) The present civil miscellaneous petition has been filed to set aside the order of dismissal for default dated 08.11.2023 made in O.S.A.No.43 of 2021 and restore the same to the file of this Hon'ble Court.

2. The learned counsel for the petitioners/appellants had advanced arguments in the main Original Side Appeal. The appeal had earlier been dismissed for non-prosecution on 08.11.2023.

3. In view of the fact that the arguments have been advanced in part in the main appeal, the petition in C.M.P.No.2045 of 2025 in O.S.A.No.43 of 2021 stands allowed and the appeal stands restored.
