Prayer in W.P.No.35550 of 2025 : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records from the 2nd respondent in application ID No.2025/N103/38/004090 dated 21.01.2025, quash the same, and consequently direct the 1st and 2nd respondents to issue patta in favour of the petitioner in respect of the property in Survey No.444/20, to an extent of 1848 sq. meters, situated at Nangur Village, Sirkali Taluk, Mayiladuthurai District, within the time stipulated by this Court. For Petitioner (in both WPs) : Mr.N.Sathish Babu For Respondents (in both WPs) : Mr.S.Arumugam Government Advocate [R1 & R2] Mr.P.Veeraraghavan [R3] ***** COMMON ORDER These Writ Petitions have been filed challenging the impugned orders, dated 21.01.2025 passed by the 2nd respondent, rejecting the petitioners' applications seeking for issuance of patta in their name, for the properties morefully described in the prayers to these writ petitions.
2. The petitioners have challenged the impugned orders on the ground that the impugned orders are non-speaking order. Under the impugned orders, the applications of the petitioners have been rejected on Page No.2 of 6
the ground that the petitioners are not in possession of the subject properties. However, the same is disputed by the petitioners as seen from the affidavits filed in support of these writ petitions. No opportunity was also granted to the petitioners prior to the passing of the impugned orders to submit their explanation with supporting documents to prove that the petitioners are in possession of the properties. The private respondent, namely the 3rd respondent was also not heard in the impugned proceedings.
3. No prejudice would be caused to the respondents, if the impugned orders are quashed and the matters are remanded back to the 2nd respondent for fresh consideration on merits and in accordance with law, after giving due consideration to the contentions as well as the supporting documents of the petitioners and the objections raised by the 3rd respondent, within a time frame to be fixed by this Court.
4. This Court is not expressing any opinion on the merits of the petitioners' applications.

For the foregoing reasons, the impugned orders, dated 21.01.2025 passed by the 2nd respondent are hereby quashed on the ground that they are non-speaking order and the matters are remanded back to the 2nd respondent for fresh consideration on merits and in accordance with law. The 2nd respondent shall pass final orders after giving due consideration to the contentions of the petitioners as well as the supporting documents filed by the petitioners as well as the 3rd respondent and the objections, if any, raised by the 3rd respondent and any other party, whom the 2nd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
6. With the aforesaid directions, these Writ Petitions are disposed of. No costs.
