ORDER
This writ petition has been filed for issue of writ of mandamus directing the 5 th respondent to deal with the representation made by the petitioner on 27.09.2024 and to issue patta in the name of the petitioner. 2.Heard Mr.B.Karthik Narayanan, learned counsel appearing on behalf of the petitioner, Mr.A.Selvendran, learned Special Government Pleader appearing
3/6 on behalf of respondents 1 & 5 and Mrs.P.T.Ramadevi, learned Standing Counsel appearing on behalf of the 4 th respondent.
3.The grievance of the petitioner is that his property was acquired under the State Highways Act. A total of 840 Sq.Ft., was acquired and the petitioner is in possession and enjoyment of the remaining 711 Sq.ft. Hence, the petitioner made a representation seeking for survey of the property and for issuance of patta for the remaining portion that was retained by the petitioner. Since the same was not acted upon, the present writ petition has been filed before this Court.
4.In the considered view of this Court, the petitioner being a senior citizen should not be made to run from pillar to post for getting a patta in his name for the property that remains with him after the acquisition. The petitioner has been making representations right from the year 2024 and there is no response. Therefore, there shall be a direction to the 5 th respondent to deal with the representation dated 27.09.2024 and conduct the survey of the subject
4/6 property by identifying the property that is retained by the petitioner after the acquisition. The boundary shall be demarcated. This process shall be completed, within a period of four weeks from the date of receipt of copy of this order. Thereafter, the petitioner shall make an on-line application before the 5 th respondent seeking for patta. The said application shall be acted upon and patta shall be issued in the name of the petitioner, within a period of four weeks from the date of receipt of the online application from the petitioner. 5.This writ petition is disposed of with the above directions.
