Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice for the respondent.

By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself. 1/5

2. This writ petition has been filed to call for the records of the respondent made in R.C.No. A6/3556/2024 dated 27.12.2024 and to quash the same and consequently to direct the respondent to reinstate the petitioner into service by considering his representation dated 08.07.2025.

3. It is stated that the petitioner was appointed as a Field Surveyor in the Thiruvallur Survey Office on 24.10.2016. Subsequently, he was promoted and transferred, and is presently working as Town Surveyor in the Office of the Settlement Tahsildar, Avadi. While so, based on a false complaint, the Inspector of Police, Vigilance and Anti-Corruption, registered an FIR in Crime No.19/AC/2024, dated 26.12.2024, against the petitioner. Subsequently, the petitioner was arrested and remanded to judicial custody, and was placed under suspension with effect from 26.12.2024, vide proceedings dated 27.12.2024. Thereafter, the petitioner submitted a representation dated 08.07.2025, seeking reinstatement into service and requesting payment of 75% subsistence allowance. However, the said representation has not been considered by the respondent, till date. Hence, the present Writ Petition has been filed.

4. Learned counsel for the petitioner submits that the FIR was registered on false allegations and that the suspension order is unjustified. However, he 2/5

prays that it would suffice if a direction is issued to the respondent to consider the petitioner's representation dated 08.07.2025, within a time frame.

5. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent.

6. This Court is of the considered view that it is well settled by a number of judgments of this Court that, in terms of G.O. Ms. No.81, Human Resources Management(N) Department, dated 04.08.2022, all orders of suspension are required to be periodically reviewed.

Replying to the above, the learned Special Government Pleader appearing for the respondent would submit that the petitioner's representation dated 08.07.2025 will be considered by the respondent in accordance with law, after affording due opportunity to the petitioner, within a reasonable time to be fixed by this Court.

8. Considering the fair submission made by the learned Special Government Pleader appearing for the respondent, without going into the 3/5

merits of the case, this Court directs the respondent to consider the petitioner's representation dated 08.07.2025, with regard to his claim for reinstatement into service, and pass appropriate orders on merits and in accordance with law, after providing an opportunity of hearing to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order. The respondent is also directed to consider the said representation in the light of guidelines issued in G.O. Ms. No.81, Human Resources Management(N) Department, dated 04.08.2022.
