This application has been filed by the applicant to condone the delay of 104 days for filing the petition to restore the above O.P.No.318 of 2002.

2. The other side have not seriously objected.

3. Considering the reasons stated in the affidavit and facts and circumstances of the case, in order to give a chance to the applicant and considering the number of days in delay, it is appropriate to allow this application. Accordingly, this application is allowed.

4. The Registry is directed to number the restore application, if it is otherwise in order.
