SATHI KUMAR SUKUMARA KURUP, J., As per the report of the learned Judicial Magistrate, Fast Track Court, Dharmapuri, letter in D.No.628/2023 dated 07.09.2023, the Accused in S.T.C.No.95 of 2013 is absconding.

2. Already this Court has addressed the learned Judicial Magistrate to take steps to proclaim the absconding Accused as proclaimed offender after receiving petition from the Complainant in this case. The learned Judicial Magistrate is directed to initiate steps to proclaim the absconding Accused as Proclaimed Offender then the properties, both movable and immovable of the absconding Accused, can be brought to sale by Public Auction to recover the dues by the Complainant. It shall be done following the procedures in Section 82 of the Criminal Procedural Code, 1973. 3.Before proceeding with declaring the accused as Proclaimed Offender, the learned Judicial Magistrate shall direct the Inspector of Police, under whose jurisdiction the Accused usually resided and owned properties, 1/3

to conduct enquiry through the Village Administrative Officer and file a report before proclaiming him as an absconding Accused. 4.Steps shall be taken through the Inspector of Police to publicise in the place of his usual residence in the Village or Town where he resides and steps shall be taken through the Police Officers concerned. 5.Copy to The Chief Judicial Magistrate, Dharmapuri and the learned Principal District Judge, Dharamapuri for supervision of the steps initiated by the learned Judicial Magistrate, Fast Track Court, Dharmapuri. 11.09.2023 vsn/mac Internet : Yes 2/3
