ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner, to suspend the sentence of imprisonment imposed in the judgement dated 10.09.2025 made in SC.No.172 of 2023 on the file of the Sessions Judge, Fast Track Mahila Court, Dharmapuri and enlarge the petitioner on bail pending disposal of the above Criminal Appeal.

2. The petitioner herein is the accused in S.C.No.172 of 2023 on the file of the learned the Sessions Judge, Fast Track Mahila Court, Dharmapuri. He was found guilty and sentencing him to undergo 2 months Simple imprisonment under Section 294(b) IPC and to undergo 5 years Rigorous imprisonment with fine of Rs.10,000/- under Section 306 IPC in default to pay the fine amount of Rs.10,000/- he shall undergo 1 year simple imprisonment, against which, the present Criminal appeal has been filed.

The learned counsel for the petitioner/accused would submit that there are arguable points available in the Criminal appeal and the

petitioner/accused has got a fair chance of succeeding in the Criminal appeal and hence, the substantive sentence imposed against the petitioner/accused may be suspended. He would submit that the petitioner is ready to abide the condition imposed by this Court.

Considering the facts and circumstances of the case coupled with the quantum of punishment imposed upon the petitioner, also by considering the submissions of the learned counsel for the petitioner, further this Criminal appeal is not likely to be taken for final hearing in the near future, this Court is of the view that the substantive sentence of imprisonment alone can be suspended on certain conditions. Accordingly, till the disposal of the Criminal appeal, the reliefs of suspension of sentence and bail are granted on the following conditions:

(a) the petitioner is directed to deposit a sum of Rs.2,00,000/- (Rupees Two lakhs only), to the credit of S.C.No.172 of 2023, on the file of the Sessions Court, Mahalir Neethimandram, Dharmapuri, and shall pay the amount within 4 weeks from the date of his release, and the said amount is ordered to be deposited in the name of 4 children of the deceased. Separately, in a nearby

post office, each children Rs.50,000/-, represented by their father. (b) the petitioner/accused is ordered to be released on bail, on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, out of which one surety shall be a blood related surety, each for a like sum to the satisfaction of the learned Judicial Magistrate, Pappirettipatti. (c) The petitioner/accused and the sureties shall affix their photographs and Left Thumb Impressions in the surety bonds and the Magistrate may obtain a copy of their Aadhaar Cards or Bank Pass Books to ensure their identities.

(d) The petitioner shall report before the respondent police on every Sunday at 10.30 a.m., and also shall appear before the Trial Court on every Saturday at 10.30 a.m., until the disposal of the Criminal Appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.

5. On considering the fact, it is revealed that deceased committed suicide, leaving behind 4 minor children, three daughters and one son, and all belonging to poor family. The Children are now suffering without their mother and are in a

poor economic conditions. Therefore, this court, refers the matter to Victim Compensation Scheme and award a sum of Rs.1,00,000/- (Rupees one lakh only) to each of the four minor children, totalling Rs.4,00,000/- (Rupees four lakh only). The said amount shall be deposited in any one of the Post office in the names of the minor children, to be kept in fixed deposit until they attain majority. The interest accrued on the said deposit shall be utilized for the welfare and educational expenses of the children,who are represented by their father. Accordingly, the District Legal Services Authority, Dharmapuri, is directed to refer the matter to the District Collector, Dharmapuri, for taking appropriate action regarding the disbursement of compensation Scheme, within 12 weeks from the date of receipt of a copy of this order. 6.

With the above directions, this Criminal Miscellaneous Petition is ordered.
