The petitioner seeks bail in Crime No.347 of 2023, registered under Sections 451, 506 (ii) IPC and Sections 7 r/w 8 of POCSO Act. The petitioner had been remanded to custody on 04.11.2023. 2.The learned counsel for the petitioner stated that the petitioner has been in incarceration for the past 34 days. 3.The statement of the victim child had been recorded under Section 164 (5) Cr.P.C. It is clear that she had reiterated the allegations made in the complaint, consequent to which, FIR had been registered. There will be a direct threat to the victim child, if ever, the petitioner is let out on bail before she deposes in the Court.
4.In view of that particular fact, I am not inclined to grant bail to the petitioner herein. Accordingly, this Criminal Original Petition stands dismissed.
