This Writ Petition is filed to issue a Writ of Certiorarified Mandamus, after calling for the concerned records from the respondent, quash the order of the respondent dated 27.04.2023, bearing J1/13357/2022, the order of the respondent dated 30.04.2023 bearing Proceedings No.J1/13357/2022 and the order of the respondent dated 02.09.2023 bearing Proceedings No.J1/13357/2022 as illegal, arbitrary and contrary to law and consequently direct the respondent to retire the petitioner with effect from 30.04.2023 and settle the terminal benefits of the petitioner such as pension, commutation of pension, death cum retirement gratuity, encashment of earned leave etc., within the time frame stipulated by this Court.
2. The learned counsel for the petitioner would submit that the 2/4
petitioner was placed under suspension on 27.04.2023 and thereafter, on 30.04.2023, he was not permitted to retire on the pretext of disciplinary proceedings. Since there was no progress thereafter, the petitioner had given a representation on 29.05.2024, requesting the respondent to allow the petitioner to retire. Such representation is yet to be considered by the respondent.
3.At this juncture, Mr.S.Karthikeyan, learned Standing Counsel appearing for the respondent would submit that they would consider the petitioner's representation within a reasonable time.
4. In view of the above submission of the learned Standing Counsel, without going into merits of the matter, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 29.05.2024 and pass appropriate orders on its own merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
