The Criminal Original Petition has been filed seeking a direction to the first respondent Police to comply with the order passed by the learned Metropolitan Magistrate (for Exclusive Trial of Cases registered and investigated by CCB Greater Chennai Police), Egmore, Chennai, in Crl.M.P.No.5325 of 2025 by an order dated 21.06.2025 Heard both sides and perused the materials available on record.
The petitioner Bank, lodged a complaint alleging criminal misappropriation of the bank's loan funds, cheating and criminal breach of trust and misappropriation of public money by filing an inflated valuation report by the accused persons. Since no action was taken by the first respondent on the petitioner's complaint, the petitioner filed a private complaint under Section 175(3) of BNSS in Crl.M.P.No.5325 of 2025 before the Metropolitan Magistrate (for exclusive trial of cases registered and investigated by CCB Greater Chennai Police), Egmore, Chennai. learned Magistrate, vide order dated 21.06.2025, directed the first respondent to conduct a detailed enquiry on the petitioner's complaint and to file a report as soon as possible.

Today, the learned Government Advocate (Criminal Side), on instructions, submitted that pursuant to the order passed by the learned Magistrate, an enquiry was conducted by the first respondent and a report was filed on 26.09.2025.

In such view of the matter, the learned Magistrate concerned is directed to apply his mind and take note of the nature of the complaint regarding inflation of the report and cheating, consider the report and if not satisfied, he may also order further investigation in this matter. 6.
Accordingly, this Criminal Original Petition is disposed of with above directions.
