The petitioner V.Kamaladevi has approached this Court with a request to correct the name of her late husband as "V.Venkataraman", which has very unfortunately been given as "VenkataRamanan" in the Death Certificate issued by the third respondent namely the Executive Officer, Town Panchayats, Minjur, Chennai. Her late husband name was V.Venkataraman and the petitioner had filed copies of her Marriage Certificate which is dated 20.04.1962 and the Pension Payment Order was issued by the Accountant General on 01.06.1962.
2. It is stated by the learned counsel for the petitioner that all these facts has been given to the third respondent and in this connection, a representation has also been submitted on 19.10.2019.
3. The learned Additional Government Pleader had taken notice on behalf of the respondents. This Court finds no justification for the inaction on the part of the third respondent in disposing of the representation of the petitioner herein. The third respondent should not have made the petitioner herein, who is aged about 84 years and a senior citizen, to approach this Court. The petitioner got married in the year 1962 and if the Death Certificate is received with the name V.Venkataramanan instead of V.Venkataraman, she might be deprived of her Family Pension and other benefits.
4. Therefore, the third respondent, namely The Executive Officer, Town Panchayats, Chennai is directed to issue a fresh Death Certificate with the correct name of the petitioner's husband as V.Venkataraman who died on 28.10.2014 forthwith.
5. With the above directions, the writ petition stand disposed of. no costs.
