Today, when the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that the suit in O.S.No.49 of 2020 has already been dismissed for default on 02.12.2024 and hence, nothing survives for adjudication. She has also made an endorsement to that effect in the case bundle.

2. In view of the above submission and the endorsement so made by the learned counsel for the petitioner, this Transfer Civil Miscellaneous Petition is dismissed as having become infructuous. Considering the facts there shall be no orders as to costs.
