ORDER
The petitioner, who was arrested and remanded to judicial custody on 30.07.2025, for the offences punishable under Sections 126(2), 296(b), 115(2), 311 and 351(3) of BNS in Crime No.405 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 11.09.2025 in Crl.O.P.No.24298 of 2025.

The case of the prosecution is that the petitioner waylaid the defacto complainant and demanded money; that on refusal of the same, the petitioner forcefully robbed Rs.750/- from the defacto complainant at knife point. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing 2/4
for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has 10 previous cases; and that the investigation is pending.

Considering the facts, gravity of offence, the previous antecedents of the petitioners, there is no change of circumstances after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.24298 of 2025 and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.
Accordingly, this criminal original petition stands dismissed. 23.09.2025 stn 3/4
