Respondent(s) PRAYER To direct the respondent forbearing in any manner interfering with affairs of the petitioners club, viz., Platinum Recreation Club (Regn. S1.No.91/2017) situated at No.Office at No.178, G.N.T.Service Road, Sholavaram, Ponneri Taluk, Thiruvallur Dist, Chennai - 600067 or its members including facilities provided for playing various games including the game of playing rummy not involving any element of gambling and to give necessary instruction to the officer's attached to Sholavaram, Police Station, as per the dictate terms of Honorable High Court order in WP.No.26397 and 27246 of 2017 dated 04.02.2022 "the petitioner shall comply with the requirements of the police authorities to install CCTV Cameras at the locations ear marked and shall furnish the footages to the police authorities, whenever required, and permit to comply guidelines of High Court direction.

ORDER

The petitioner seeks for issuance of a Writ of Mandamus forbearing the respondents in any manner interfering with affairs of the petitioners club, viz., Platinum Recreation Club (Regn. S1.No.91/2017) situated at No.178, G.N.T.Service Road, Sholavaram, Ponneri Taluk, Thiruvallur Dist., Chennai - 600067.

It is the case of the petitioner that the petitioner Club is registered under the Tamil Nadu Societies Registration Act and its main object is to promote gaming activity within the ambit and purview of law to encourage young talent. The club is assessed by the members for playing 13 card rummy th respondent police entered into the game, Carom and Chess. However, the 5 Club premises on non functioning hours and registered a false FIR in Crime No.523 of 2025 under Sections 7 & 9 of Tamil Nadu Gambling Act.

3. The grievance of the petitioner is that though the petitioner Club is following all the rules, the Police come for a search on day to day basis and harassed the employees in the Club.

4. Therefore, the petitioner seeks a direction not to interfere with affairs of the petitioner/Club. According to the petitioner/Club, their Club is being run in a legal manner, however, the respondents-Police have been harassing and interfering with the activities of the petitioner/Club unnecessarily.

5. The learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, submitted that already an F.I.R. has been registered against the petitioner/Club for the alleged gambling. Therefore, such a direction cannot be given.

6. It is relevant to note that when there is an evidence of gambling, Police have every right to enter into the premises of the petitioner/Club. Admittedly, in the present case, already an F.I.R. has been registered against the petitioner/Club. In such view of the matter, there cannot be any direction from this Court. The petitioner/Club should not carry out any illegal activities and they shall fix CCTV cameras in all the required places in the Club and ensure transparency in the Club activities.

7. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions is closed.
