ORDER

The petitioner has filed this writ petition seeking for issuance of a Writ of Mandamus to direct respondents 1 to 3 to consider and dispose of his representation dated 02.06.2025 to cancel the legal heirship certificate vide certificate number TN-720190112141.

2.The case of the petitioner is that he is the adopted son of the adopted parents Ganapathi and Neela and the petitioner and his sister Murugavallai, the fourth respondent herein are the legal heirs of the deceased mother Neela, who died on 27.02.2003 and the deceased father Ganapathi, who died on 22.07.2007. The grievance of the petitioner is that though one Abbu is none other the father in law of Neela and father of Ganapathi, the fourth respondent has obtained legal heirship certificate mentioning as 'Neela, wife of Abbu' instead of 'Neela, wife of Ganapathi'. Therefore, the petitioner has made a representation dated 02.06.2025 to respondents 1 to 3 to cancel the legal heirship certificate. Since the said representation has not been considered, the petitioner is before this Court. 2/4

3.Learned counsel for the petitioner would submit that though the petitioner's adopted father is Ganapathi, who died on 22.07.2007 and his adopted mother is Neela, who died on 27.02.2003, the legal heirship certificate has been issued to the petitioner's sister, the fourth respondent mentioning as 'Neela, wife of Abbu' instead of 'Neela, wife of Ganapathi'. Therefore, the learned counsel for the petitioner prays for appropriate orders for cancellation of the legal heirship certificate. 4.Mrs.S.Anitha, learned Special Government Pleader, who accepts notice on behalf of respondents 1 to 3, submits that the petitioner's representation dated 02.06.2025 for cancellation of the legal heirship certificate will be considered and appropriate orders will be passed by respondents 1 to 3, within a time frame fixed by this Court. 5.

Considering the request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs respondents 1 to 3 to consider the petitioner's representation dated 02.06.2025, on merits and in accordance with law and pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order.
