O R D E R

This Petition has been filed to set aside the condition imposed by the learned Additional District Judge and Presiding Officer, Special Court under EC and NDPS Act cases at Salem on 09.12.2022 in

C.M.P.No.1238 of 2022, wherein, the learned District Judge had imposed a condition that the Petitioner herein should appear before the Respondent Police every month 1st Monday at 10.30 a.m., till the filing of the final report.

2. The grievances raised by the learned counsel for the Petitioner is that the Petitioner is the native of Orissa and will have to come over every month and therefore, is put to much difficulty. The Court wanted the status of investigation to be presented and it is informed that the FSL report is still awaited. Therefore, the Respondent are not able to file final report before the Court.

3. Taking all the factors into consideration, instead of setting aside the order, I will direct the Petitioner to appear before the Trial Court concerned, once every two months i.e., on 1st Monday of every two months at 10.30 a.m., and also on Court hearing dates till the final report is filed and the same is taken cognizance by the Trial Court. But the direction to appear once in every two months shall continue till completion of trial.

4. Accordingly, this Criminal Original Petition is disposed of.
