The Petitioner seeks anticipatory bail in Crime No.12 of 2022 registered by the respondent police for the offences under Sections 417 and 376 IPC.

2. The learned Government Advocate (Criminal Side) stated that the Petitioner and the defacto complainant had a relationship which moved on to physical relationship, consequent to which, a child had also been born to the defacto complainant.

3. The learned counsel for the Petitioner stated that the Petitioner is an innocent person and he was not connected to the above incident. He also stated that the Petitioner is ready to subject himself for the medical examination.

4. But the investigation will have to be done and the Petitioner need not have attracted filing of the First Information Report if he had express readiness to marry. He could have even married before the complaint 1/3

had been lodged. Expressing such intention, after the complaint had been lodged, has to be viewed with skewed eyes.

5. Therefore, I am not inclined to grant anticipatory bail to the Petitioner herein. Accordingly, this Criminal Original Petition stands dismissed.
