This writ petition has been filed challenging the order passed by the respondent, suspending the petitioner from service pending enquiry into the grave charges. This order was passed on 29.08.2019.

The case of the petitioner is that he was regularized in the post of Night Watchman in the year 2012. A suspension order came to be issued against the petitioner on 29.08.2019 in contemplation of enquiry into grave charges. The grievance of the petitioner is that the suspension is continuing beyond the period of three months inspite of the fact that there is no criminal case that has been filed against the petitioner. Therefore, according to the petitioner, the continuation of suspension is illegal and it requires interference of this Court.

3.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the respondent to consider the representation made by the petitioner on 14.11.2019 and take a decision with regard to revocation of the suspension, on its own merits and strictly in accordance with law, within a period of six weeks from the date of receipt of copy of this order. The petitioner is directed to give a fresh representation to the respondent along with copy of the representation dated 14.11.2019 and a copy of this order.
5.This writ petition is disposed of with the above directions.
No costs.
Consequently, the connected miscellaneous petitions are closed.
