3. To the query of this Court, whether the Respondent has counter and objection in restoring the Appeal. The learned Counsel for the Respondent submitted that he has no objection.

4. In the light of the submission of the learned Counsel for the Respondent, this Petition is allowed.

5. The learned Counsel for the Appellant is directed to proceed with the arguments on the next date of hearing, failing which Appeal will be dismissed once again for default.
