ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.08.2025, for the offences punishable under Sections 296(b), 309(4), 311 and 351(3) of BNS in Crime No.161 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 01.09.2025 in Crl.O.P.No.23981 of 2025.

The case of the prosecution is that the petitioner under the pretext of purchasing fruits from the defacto complainant, extorted a sum of Rs.2,000/- at knife point and also threatened the defacto complainant of dire consequences. Hence, this case.

The learned counsel appearing for the petitioner submitted that the a false case has been foisted against the petitioner by the respondent police; that the defacto complainant in this case had given a representation on 18.08.2025 to the District Collector, Vellore that he has not given any complaint to the respondent police, he has no grievance against the 2/4

petitioner and the respondent police had obtained his signature in an empty paper. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has 3 previous cases of similar nature; and that the investigation is pending. 5.

Though the learned counsel for the petitioner submits that the defacto complainant has given a representation stating that there is no grievance as against the petitioner, the genuineness of the same has to be verified and the same is also not a ground to grant bail. 6.

Considering the facts, grave nature of offence, the previous antecedents of the petitioners, there is no change of circumstances after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.23981 of 2025 and the fact that investigation is pending, this 3/4

Court is not inclined to grant bail to the petitioner. K. RAJASEKAR, J.
