Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the proceedings in order No.1838880/ 2024/ AA3 dated 25.08.2025 on the file of first respondent and quash the same as illegal, incompetent arbitrary and time barred and further direct the third respondent to issue the patta in the name of the petitioner.

For Petitioner : M/s R.Abirami For R1 to R3 : Mr.C.Jayaprakash Government Advocate O RDER This Writ Petition has been filed challenging the order passed by the first respondent dated 25.08.2025, thereby rejecting the request made by the petitioner seeking cancellation of patta.

2. Heard the learned counsel for the petitioner, the learned Government Advocate for the respondents 1 to 3 and perused the materials available on record.

The petitioner claims that he is the owner of the property comprised in S.Nos.373/12B, 373/6A, 373/7C, 373/1A, 373/5B and 373/13B to an extent of 3.38 acres situated at No.111, Alamathi-2 Village, Sozhavaram Zone, Ponneri Circle, Thiruvallur district and the same was acquired by the registered sale deed dated 15.06.2005 vide Document No.2973 of 2005. While being so, the third parties trespassed into the subject property and removed the fencing put up by the petitioner. Thereafter, on verification, the petitioner came to understand that the patta in respect of the subject property was issued in favour of one A.Somasundaram, who is none other than the father of the fourth respondent.

Further, the said A.Somasundaram had acquired the property by forged documents. Therefore, the petitioner submitted a representation seeking cancellation of patta. However, the said request was rejected and directed the petitioner to approach the civil Court for appropriate relief.

4. It is seen that there is a title dispute in respect of the subject property between the petitioner and the respondents 4 and 5 herein. The object of the Tamil Nadu Patta Pass Book Act, 1983 is to issue patta to the holders of the land. The persons holding title and possession are entitled to secure patta by submitting the application. In the event of any dispute regarding title, ownership, boundaries or possession etc., the revenue authorities have to relegate the parties to approach the competent civil Court for appropriate relief. Therefore, the adjudication of civil dispute either by revenue authorities or under the writ proceedings are impermissible and the competent civil Court is alone empowered to declare the title.

5. Therefore, the request of the petitioner was rightly rejected by the first respondent. Hence, this Court finds no infirmity or illegality in the order passed by the first respondent in order No.1838880/ 2024/ AA3 dated 25.08.2025 and the writ petition is devoid of merits and is liable to be dismissed.
