ORDER

This Court as early as on 29.11.2024 appointed an Advocate Commissioner to repossess the vehicle from the respondent or wherever available. Till date, the vehicle has not been re-possessed by the Advocate Commissioner. 2.Learned counsel for the applicant would submit that the parties are negotiating and trying to arrive at a settlement. The respondent has also not entered appearance and an interim report has been filed by the Advocate Commissioner dated 03.01.2024 stating that the vehicle is yet to be located. The applicant has paid the initial remuneration of Rs.25,000/- to the Advocate Commissioner.

vga 3.Since the vehicle has not been located till date, no useful purpose will be served if this application is allowed to be kept pending. 4.Accordingly, this application is closed by granting liberty to the applicant to file a fresh application seeking for the very same relief, once the vehicle is located by the applicant.

5.While considering the fresh application to be filed by the applicant in the near future, this Court will consider retaining the very same Commissioner appointed by this Court in this application as the applicant has already paid the Advocate Commissioner's initial remuneration of Rs.25,000/-. 03.03.2025 vga Arb.Appln.
