ORDER

This writ petition is filed to direct the first respondent to dispose of petitioner's representation dated 19.03.2025 to take action by remove their brother Solomon/5th respondent from service for getting job on compassionate ground by producing the fraudulently document.

2. The case of the petitioners is that the petitioners and the fifth respondent are legal heirs of Mr.V.Srinivasan, who worked as Sanitary Worker in the Greater Chennai Corporation. After his demise on 22.02.2013, the petitioners along with fifth respondent approached the Greater Chennai Corporation with proper channel for death benefits, provident fund, Gratuity and other benefits and for job under compassionate ground. However, without any intimation or permission, the fifth respondent got the job of his father on compassionate ground by submitting forged document of consent and no objection from the petitioners. Thus, the petitioners herein made a representation to the respondents 1 to 4 to take action against the fifth respondent. However, the same was not considered. Hence, this writ petition.

3. Heard the learned counsel on either side and perused the materials available on record.

When this Court expressed its opinion, that the issue involved in the present case pertains to disputed questions of facts, the same cannot be entertained under Article 226 of the Constitution, the learned counsel for the petitioner restricted his prayer and sought permission of this Court to approach the appropriate forum.

5. Accordingly, this writ petition is dismissed with a liberty to the petitioner to approach the appropriate forum. No costs. 30-01-2026 Index: Yes/No Speaking/Non-speaking order VM
