ORDER

The petitioner, who were arrested and remanded to judicial custody on 20.08.2025, for the offences punishable under Section 310(4) of BNS in Crime No.548 of 2025, registered on the file of the respondent police, seek bail.

The case of the prosecution is that while the respondent police were on their routine patrol duty, the petitioners along with other accused were found in illegal possession of iron rods and preparing for dacoity. Hence, this case.

The learned counsel appearing for the petitioners submitted that the petitioner were falsely implicated, they were no way connected to the offence and they are in judicial custody since 20.08.2025. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the 2/4

prosecution case and states that there are totally five accused and the petitioners herein are arrayed as A1 and A5. He further submitted that the petitioners have previous antecedents; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the previous antecedents of the petitioners and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioners. 6.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
