ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.08.2025, for the offences punishable under Sections 4(1)(C), 4(1-A)(ii) of TNP Act in Crime No.41 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 16.08.2025 based on a secret information, the respondent police went to the spot and found that the petitioner was in illegal possession of ID arrack. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and the petitioner is in judicial custody since 22.08.2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that totally 5 liters of ID arrack involved in this 2/4

case and the petitioner has 27 previous cases and the petitioner was also involved in the Kallakurichi tragedy case.

Considering the facts, gravity of offence, the previous antecedents of the petitioner and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.
