O R D E R

This Criminal Original Petition has been filed to set aside the order dated 19.08.2025 passed in C.M.P.No.3203 of 2025 by the learned Judicial Magistrate No.I, Virudhachalam, in Crime No.310 of 2025 and consequently direct that the bail as granted to the petitioner by this Court in Crl.O.P.No.19013 of 2025 dated 03.07.2025 shall continue to remain in force.

The case of the petitioner is that the petitioner who is an accused in Crime No.310 of 2025 on the file of the respondent police, for the offences under Sections 336(2), 336(3), 318(4), 296(b) and 351(2) of BNS was granted bail by this Court vide Crl.O.P.No.19013 of 2025 dated 03.07.2025 with certain conditions and one of the conditions is that the petitioner has to report before the respondent police daily at 10.30 a.m. for a period of three weeks and thereafter, as and when required for interrogation. However, the petitioner signed before the respondent police only for 9 days. Therefore, the bail granted to the petitioner was cancelled by the learned Judicial Magistrate No.I, Virudhachalam, by order dated 19.08.2025 based on the application filed by respondent police in C.M.P.No.3203 of 2025 taking note of the violation of bail condition. Hence, challenging the same, the present petition is filed. 2/4

3. When the matter came up before this Court on 24.09.2025, this Court had directed the petitioner/accused to sign regularly before the respondent police for the remaining period. Now it appears that the petitioner is regularly signing before the respondent police and no adverse report has been brought against the petitioner by the prosecution.

4. In view of the above, the order of the Judicial Magistrate in canceling the bail order, is set aside. The original order of this Court dated 03.07.2025 passed in Crl.O.P.No.19013 of 2025 granting bail to the petitioner, is restored.
