ORDER

The proposed suit is for recovery of money and the present application is for leave to sue the 2nd respondent/2nd defendant.

2. According to the applicant, the 2nd respondent has entered into a Finance Agreement on 27.06.2023 with the applicant and the 1st respondent. In clause 5 of the Finance Agreement, it is stated that the Courts in Chennai alone shall be deemed to have jurisdiction.

3. Upon considering the draft plaint and the affidavit in support of the application, it appears that at least part of the cause of action has arisen within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the respondents before this Court.
