The petitioner who is arrayed as A3 in C.C.No.203 of 2019 now pending trial before the learned Judicial Magistrate, Uthukuli, Tiruppur District, seeks bail.
2.Originally, Crime No.42 of 2018 had been registered by the respondent Police for the offences under Sections 457 and 380 of IPC. 3.The petitioner had been granted bail but non bailable warrant had been issued against him and the petitioner had been taken into custody on 12.10.2023. The matter came up on 19.12.2023 and it was observed that the matter was posted for examination of investigating officer on 20.12.2023. 4.But it is now stated that the petitioner has filed a petition under Section 311 Cr.P.C seeking to recall further witnesses. The petitioner will have to suffer incarceration till the completion of the trial. 5.At this stage, I am not inclined to grant bail to the petitioner. 6.Hence, this Criminal Original Petition is dismissed. 08.01.2024 vkr 1/2 https://www.mhc.tn.gov.in/judis
