This application has been filed by the applicant / 1st defendant seeking to condone the delay of 86 days in filing the written statement in the above Suit.

2.The Suit is filed for recovery of money.

3.Considering the nature of the allegations made in the plaint, in order to give a fair opportunity to the defendants to agitate the rights on merits, this Court is taking a lineant view in condoning the delay.

4.Accordingly, the delay is condoned and the application is ordered as prayed for and the written statement is taken on file.

5.Post the Suit for framing issues on 11.01.2024.
