Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondent herein for his act of willful disobedience to the order of this Court passed in Crl.O.P.No.15367 of 2023 dated 11.07.2023.

ORDER

This contempt petition has been filed for wilful disobedience of the order passed in Crl.O.P. No.15367 of 2023 dated 11.07.2023.

2. Mr.K.Selladurai, Sub Inspector of Police, Namakkal Town Police 1/4

Station, Namakkal District, is present before this Court.

3. When the matter was taken up for hearing, the learned Government Advocate (Crl.Side), submitted that the investigation was completed and a Referred Charge Sheet was filed before the learned Judicial Magistrate I, Namakkal, on 11.01.2024. The learned Government Advocate further submitted that RCS notice was sent to the petitioner in RCS No.1/2024, by Registered Post.

4. The learned counsel appearing for the petitioner submitted that till date, the petitioner has not received any notice and he was not even aware that the Referred Charge Sheet was filed.

5. Considering the above development, there shall be a direction to the respondents to serve RCS notice to the petitioner in person on or before 22.01.2024. On receipt of the same, it is left open to the petitioner to file a protest petition before the concerned Court.

6. This Contempt Petition is disposed of with the above terms. No costs.
