O R D E R

The petitioners herein apprehend arrest at the hands of the respondent police for the offence punishable under Sections 303(2) and 326(a) of BNS 1/4

Act, 2023 in Crime No.144 of 2025 on the file of the respondent, seek anticipatory bail.

2.The case of the prosecution is that the petitioners were illegally transported 10 buckets of river sand in a TATA Ace vehicle bearing registration No.TN-23-BB-267 at Ponnai river, Kamarajapuram. Hence, the case.

3.The learned counsel for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that there are no previous cases pending against the petitioners. However, he opposed to grant anticipatory bail to the petitioner.

5.Since the petitioners involved in demolishing the ecology of the river and though the petitioners are not having any previous cases, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed.
