This Writ Petition is filed for issuance of a writ of mandamus, directing the respondents to assign appropriate placement in the temporary panel drawn vide G.O.Ms.No.467 Home (Transport-II) Department dated 03.09.2025 on the basis of the petitioner's representation dated 03.09.2025 on merits and as per law within a time to be stipulated by this Court.

2. It is the case of the petitioner that she was initially appointed as a Motor Vehicle Inspector Grade-II in the year 1998. She was subsequently promoted to the post of Motor Vehicle Inspector Grade-I in 2002. Thereafter, she was promoted to her current position of Regional Transport Officer in the year 2010. Her next avenue of promotion is to the Post of Deputy Transport Commissioner.

The petitioner would submit that while she was rendering service as RTO, Salem, she was falsely implicated in a surprise check conducted on 30.09.2021 alleging that she had permitted unauthorised persons inside her office premises with unaccounted money. Thereafter, disciplinary proceedings were initiated against the petitioner and an enquiry was conducted.

4. The petitioner would further submit that, after carefully examining the enquiry report submitted by the Enquiry Officer, the 1st respondent, by an order dated 22.08.2025, dropped the charges against her.

Since the charges were dropped, the petitioner submitted a representation dated 03.09.2025 through proper channel to the respondents to include her name in the panel of promotion for the post of Deputy Transport Commissioner. However, the same has not been considered to date. Hence, the Writ Petition.

6. Mr. V.Jeevagiridharan, learned AGP appearing on behalf of the respondents would submit that though the petitioner claims that she has sent a representation dated 03.09.2025, there is no proof for the same.

7. Heard the learned counsel on either side and perused the records.

8. Taking into account that fact that the charges against the petitioner have been dropped by the proceedings of the 1st respondent dated 22.08.2025, the petitioner is directed to give a fresh representation to the 1st respondent within a period of 1 week from the date of receipt of 3/5

a copy of this order and thereafter within a period of four weeks, the 1st respondent shall consider the same and pass orders on merits and in accordance with law.
