ORDER

This Writ Petition has been filed for a direction, directing the second respondent to pay interest at the rate of 10% per annum on delayed payment of gratuity amount.

2. Heard the learned counsel appearing for the respondents. There is no representation for the petitioner, hence, this Court is inclined to pass orders on merits.

3. The petitioner was employed as Trained Gratuate Teacher in the respondents School from 16.05.1998. Thereafter, she attained the age of superannuation and retired from service on 31.05.2016. The petitioner is entitled for gratuity and other benefits from the respondents School. She was paid all retirement benefits except gratuity. The gratuity amount was paid after a period of three years. Therefore, the petitioner submitted a representation seeking interest for the belated payment of gratuity amount.

4. The learned counsel appearing for the respondents would submit that the petitioner has to ask for interest from the authority concerned and the second respondent are not liable to pay any interest for the gratuity amount, which was belatedly paid by the authorities, under the Gratuity Act.

5. Therefore, the representation submitted by the petitioner cannot be considered. Thus, the writ petition itself is devoid of merits and it is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. No costs.
