Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondents to forthwith and in any event within the time as may be fixed by this Court to pay to the petitioner a total sum of Rs 62,82,858/- due towards refund of the security deposit for establishment of 1 MW plant as well as the dues directed to be paid by this Court in its order dated 16.04.2024 in W.M.P No 9832 of 2024 in W.P. No.6533 of 2024, along with interest thereon at 12% p.a., or to adjust the said amount against the petitioner's current consumption bills in its HTSC No. 019094022140 until the entire sum is refunded or adjusted in full. ORDER
The petitioner has filed this writ petition seeking for issuance of a Writ of Mandamus to direct the respondents to forthwith pay them a total 2/6
sum of Rs.62,82,858/- due towards refund of the security deposit for establishment of 1 MW plant as well as the dues directed to be paid by this Court in its order dated 16.04.2024 in W.M.P No 9832 of 2024 in W.P. No.6533 of 2024, along with interest thereon at 12% p.a., or to adjust the said amount against their current consumption bills in its HTSC No. 019094022140 until the entire sum is refunded or adjusted in full. 2.Learned counsel for the petitioner would submit that this Court, in the similar cases as that of the petitioner, had issued directions to the respondents to adjust the security deposit in the current consumption charges payable by the petitioners therein. Learned counsel for the petitioner submitted that this Court vide order dated 13.03.2024 in W.P. No.
6533 of 2024 directed the respondents not to collect the current consumption charges or any arrears for consumption of HTSC No.019094022140 till the entire outstanding sum of Rs.1,08,64,539/- along with interest at 12% is exhausted, in line with the judgment of the Hon'ble Supreme Court in Civil Appeal No.15618 of 2017 (TANGEDCO v. Century Flour Mills Ltd. & another) dated 26.08.2022. Learned counsel for the petitioner prays for the similar order.

3.Mr.D.R.Arun Kumar, learned Standing Counsel, who accepts notice on behalf of the respondents, submits that the petitioner's case will be considered and appropriate orders will be passed by the respondents. 4.In view of the same, there will be a direction to the respondents to refund or adjust the eligible amount in the current consumption charges payable by the petitioner. Such adjustment shall start from the next bill. Till such adjustment is over, they shall not disconnect and the needful as indicated above shall be undertaken by the respondents and the communication to be made to the petitioner within a period of two weeks from the date of receipt of a copy of this order. 5.The writ petition is disposed of accordingly.
