Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Certiorarified Mandamus, call for records relating to the order of the 1st respondent dated 21.03.2025 bearing Roc No. 8093/2025/VI and quash the same and consequently direct the 1st respondent to consider the representation of the petitioner and place the petitioner in some non-sensitive post till completion of the criminal proceedings.

ORDER

Challenging the order of suspension dated 21.03.2025, the petitioner is before this Court.

2. The petitioner was appointed as a Sanitary Inspector, in Tiruvannamalai Municipality on 10.02.2014. On 08.11.2022, the 2/7

petitioner was transferred to Villupuram Municipality. The case of the petitioner is that he was placed under suspension by order dated 21.03.2025. The petitioner has sent a representation dated 10.09.2025 seeking to revoke the suspension order in the light of the Government Order in GO.Ms.No.81, dated 04.08.2022. However, it has not been considered so far. Therefore, the petitioner has approached this Court.

3. The learned counsel for the petitioner would submit that the suspension order may be revoked and the petitioner may be directed to be posted in a non sensitive post.

4. The learned Additional Government Pleader for the respondents would submit that the petitioner was involved in a corruption case and he was arrested and granted bail. Therefore, the petitioner was placed under suspension. Hence, he sought for the dismissal of the Writ Petition.

5. The learned counsel for the petitioner, in reply, would submit that without going into the merits of the case, the representation of the petitioner may be directed to be considered and orders passed, within a time frame.

6. Heard the learned counsel on the either side and perused the records.

7. Admittedly, as stated above, the petitioner was arrested for demanding and accepting bribe. Subsequently, he was granted bail by this Court. Based on this criminal case, the petitioner was suspended from service on 21.03.2025. On 10.09.2025, the petitioner sent a representation seeking to revoke the suspension order dated 21.03.2025. Since there is no progress, the petitioner is before this Court.

8. Considering the fact that the petitioner has been suspended and his representation dated 10.09.2025 has not been considered till date, a 4/7

direction is issued to the 1st respondent to consider and pass orders on the representation of the petitioner dated 10.09.2025, in the light of the Government Order in GO.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, within a period of 8 weeks from the date of receipt of a copy of this order.

9. With the above direction, the Writ Petition stands disposed of. Consequently, the connected miscellaneous petitions are closed. No costs.
