ORDER

The writ petitioner is challenging the E-Tender Notification issued by the Government of Puducherry dated 29.08.2025.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents and perused the materials available on record.

3. The main grievance of the petitioner is that the Government has tweaked the tender conditions to suit one favourable bidder. The petitioner is a dealer of TVS Motors. According to the petitioner, the Government has issued a tender for procuring vehicles for differently abled persons. The engine capacity was fixed at 75 CC to 110 CC. However, the conditions were later modified to accommodate its rival a Hero Honda Company and Engine capacity was fixed at 75CC to 110 CC +- 1CC Tolerance. This, according to petitioner is done with the malafide intention of accommodating the Hero Honda Company since the Hero Honda companies scooter is 10.99 CC and not 11 CC. This Court is not inclined to go into the averments in the affidavit. It is for the Government of Puducherry to fix the conditions for procuring the vehicles for differently abled persons. The tender is not yet finalised. The Government has merely issued tender notification. The petitioner has challenged the same on the ground that the conditions are twisted to favour to one particular player. Nothing stop the

petitioner to participating the tender to quote a bid lower than its competitors. The present writ petition is highly pre-mature and it is liable to be dismissed.

4. Accordingly, the writ petition is dismissed. No costs.
