Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 697 days in filing the above writ appeal against the order dated 19.12.2017 made in WP.NO.2390/2004.(IN CMP.NO.27558/2019) Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.C.JAYAPRATHAP, Advocate for the petitioner and of Respondent not appearing, the court made the following order:-
This petition is filed to condone the delay of 697 days in filing the writ appeal against the order dated 19.12.2017 made in W.P.No.2390 of 2004.
2. Though the respondents are served with notice, there is no representation for them either in person or through counsel.
3. Heard the learned Government Counsel for the petitioners/appellants.
4. Upon hearing the submission made by the learned Government Counsel counsel for the petitioners/appellants and on being satisfied with the reasons stated in the affidavit filed in support of the petition, the petition is allowed on condition that the petitioners/appellants shall pay a sum of Rs.2,000/- (Rupees two thousand only) to the Chief Justice Relief Fund within a period of two weeks from the date of receipt of copy of this order, failing which, the order shall stand vacated automatically without further reference to this Court.
5. The Registry is directed to number the appeal upon production of proof of payment of Rs.2,000/-, if it is otherwise in order and list the same for admission.
