These Civil Miscellaneous Petitions are filed to condone the delay of 1328 days in filing the set aside abatement caused due to the death of Anniyappan; to bring on record the legal heirs of deceased Anniyappan; to set aside the abatement caused due to the death of Anniyappan in the above Second Appeal.

2. I have gone through the affidavit in support of the application.

3. The Learned Counsel for the 1st respondent has no objection in allowing these applications. Accordingly, these Civil Miscellaneous Petitions are allowed.

4. Issue notice to the newly impleaded respondents returnable by 25.03.2024. Post this matter on 25.03.2024.
