ORDER
The petitioner, who was arrested and remanded to judicial custody on 23.08.2025 for the alleged offences punishable under Sections 126(2), 1/4
296(b), 115(2), 311 and 351(3) of BNS, 2023 in Crime No.701 of 2025 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with another accused waylaid the de-facto complainant and robbed a sum of Rs.3,500/- at knife point. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner. 4.The learned Government Advocate (Crl. Side) submitted that in this case there are totally two accused, the petitioner is ranked as A1 and the petitioner is having two previous cases, one under NDPS Act and another under Section 506(ii) of I.P.C. He further submitted that the bail petition filed by the co-accused/A2 was dismissed by this Court on 11.09.2025 in 2/4
Crl.O.P.No.24890 of 2025. Hence, he strongly opposed to grant bail to the petitioner.
5.Heard both sides and perused the materials available on record. 6.This Court finds that earlier bail application filed by the co-accused/A2 was dismissed by this Court on the ground that the offence is very serious in nature, apart from that this petitioner is having two previous cases and the petitioner was arrested only recently. Therefore, I am not inclined to grant bail to the petitioner at this stage.
