ORDER

This Writ Petition is filed seeking a Writ of Certiorarified Mandamus calling for the entire records from the file of the 3rd respondent pertaining to the order dated 09.10.2023 in RFL/Kunnathur/27/2023 and RFL/Kunnathur/26/2023 and quash the same consequently direct the 3rd respondent to register the settlement deeds dated 07.06.2023 presented for registration by the petitioners and return the same to the petitioners within a time frame to be fixed by this Court.

When the matter came up before this Court on 02.01.2024, the petitioners claimed title based on the judgment and decree dated 06.02.2023 passed in O.S.No.208 of 2014, on the file of the I Additional District and Sessions Court, Tiruppur and since it was not known as to whether any appeal was preferred by the defendants in the said suit, this Court had directed the petitioners to implead the defendants in the said suit as 2/5

respondents 4 to 11 in the present writ petition and this case was ordered to be listed after two weeks.

3. However, today (18.01.2024), when the matter is taken up for hearing, the earlier order of this Court dated 02.01.2024 was not complied with by the petitioners. Therefore, this Court is not inclined to entertain this writ Petition.

4. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. The connected Miscellaneous Petition is ordered subject to payment of separate Court fee by the other writ petitioners. 18.01.2024 ksa-2 Index : Yes / No Speaking Order : Yes / No 3/5
