ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326 of BNS, 2023, Act, in Crime No. 68 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with others 1/6

had transported illegally 10 units of river sand by using lorry bearing Registration No. AP-39-UV-1117 without any valid permission from the Government of Tamil Nadu. Hence the case.

3. The learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the investigation is not yet completed and huge quantity of sand illegally quarried and damage is caused to the water body. Hence, he strongly opposed for grant of anticipatory bail to the petitioner.

5. Taking into the fact that the gravity of the offence was committed by the petitioner, and investigation is not yet completed and the submissions made by the learned Counsel on either side, this Court is not inclined to 2/6

allow this Criminal Original Petition.

6.Accordingly, this Criminal Original Petition is dismissed. 17-09-2025 MSM To 1.The JM, Katpadi.
