This petition is filed to condone the delay of 342 days in filing the appeal against the Judgment and Decree dated 01.08.2023 made in M.C.O.P.No.833 of 2018 on the file of the Motor Accident Claims Tribunal, Principal District Judge, Perambalur.

Learned counsel for the petitioner/appellant submitted that notice to the 6th respondent may be dispensed with, since he remained ex-parte before the Tribunal and he has also made an endorsement to that effect. Hence, notice to the 6th respondent is dispensed with.
3. Heard the learned counsel for the petitioner/appellant.
4. Though name of the respondents 1 to 5 has been printed in the cause list, they have not entered appearance either in person or through counsel.
5. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.
6. Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
